New Proposals and Emerging Practices: A Discussion between Europe and Asia on EHRDD

In an emergent COVID-19 recovery period, settled trade and investment relations between regions is being considered closely, and expectations are rising quickly for greater respect for human rights in business operations and supply chains. Recently, the EU Commission issued its proposed Directive on corporate sustainability due diligence to strengthen respect for human rights among EU business and partners. But what impact, if any, with the proposed Directive have in Asia? What are some of Asia’s views on the topic? To clarify these and other issues, UNDP B+HR Asia, in partnership with the European Union, will host a discussion with EU representatives and Asian policy makers and experts to understand the most important features of the proposed directive and how it may shape complementary Environmental and Human Rights Due Diligence (EHRDD) efforts underway in Asia.

For any business almost 90% of its supply chain including tier 1 and definitely tier 2 and 3 is in medium, small and micro.
This is for proportionality reasons. Although SMEs are not included in the scope of this Directive, they will be impacted by its provisions as contractors or subcontractors to the companies which are in the scope. The aim is nevertheless to mitigate financial or administrative burden on SMEs, many of which are already struggling in the context of the global economic and sanitary crisis.
In addition to specific support to their established SME business relationships, if large companies verify compliance to their code of conduct by SMEs, they shall bear the cost of the independent third-party verification and when contractual assurances are obtained from, or a contract is entered into, with an SME, the terms used shall be fair, reasonable and non-discriminatory.
